(“wall:in”) has developed and is owner of the “wall:in” platform, and as such is the owner of the relationship with the users of wall:in, in the manner regulated by the following terms of services. These Terms of Services (the “Terms”) govern the access and use of the website wall:in and of the sites and services that can be connected to it (the “Services”), and any information, text, graphics, photos or other material (the “Contents”) uploaded, downloaded or appearing on the Services. Access to and use of the Services is conditioned upon acceptance and compliance with these terms. By accessing or using the services you agree to be bound by these Terms.

 

Basic Conditions

The user is responsible for any Contents uploaded to the Services, and for any consequential consequence. wall:in does not intend to approve, support, represent or guarantee completeness, truthfulness, accuracy or reliability none of the Contents or communication published through its Services, wall:in does not intend to endorse the opinions expressed through them. By using the Services, you are therefore aware that you may be exposed to Contents, which could be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases misunderstood or misleading.
In no case and in any way wall:in will be responsible for the Contents, including any errors, omissions, losses, damages or otherwise of any kind, due to the use of published Contents, sent by email, transmitted, or made available by other Services or transmitted elsewhere.

All rights, title and interest in and to the Services (excluding User Generated Contents) are and will remain the exclusive property of wall:in and its licensors. The Services are protected by copyright, trademarks and other laws of both Italy and foreign countries. Nothing contained in the Conditions gives the user the right to use the name of wall:in and its trademarks, logos, domain names and other distinctive features of the trademark itself. Any feedback, comment or suggestion that the user should provide about wall:in or its Services is entirely voluntary and wall:in will be free to use it as it deems appropriate without any obligation to the user.

 

Regulatory Compliance and Copyright

wall:in wants that the published Contents are compliant with current legislation, also to the legislation on copyright, and is not in any way offensive, harmful or otherwise inappropriate or misleading. wall:in, therefore, will collect the reports relating to any alleged violation of laws and regulations, also with regard to the legislation on copyright, and will verify them with due diligence. Therefore, without prejudice to the exclusive responsibility of the User referred in the following paragraph, the User accepts and recognizes the right to wall:in, at its sole discretion, to modify and/or remove all Contents, due to received reports, or on its own initiative, without the need for notification, be it preventive or subsequent. wall:in reserves also, at its discretion, the right to suspend, limit, block or delete any account, in case the User is held responsible for violations of these Terms.

 

Limitations of responsibility

wall:in does not assume any responsibility for the Contents objects of its Services and/or objects of third party sites reachable through the Contents and/or for any malfunctions of its Services and/or that reached through its own.
wall:in will make every reasonable effort to eliminate errors, inaccuracies and/or omissions contained in the services, looking at them diligently and accurately.
In any case, wall:in decline any responsibility for errors, inaccuracies and omissions that may be present in the Services and/or in the Contents.
No responsibility can be ascribed to wall:in in relation to the Services and/or the Contents and/or the interconnections (constituted, by way of example and not exhaustive by: hyperlinks, links to other sites/applications) generated by them and/or the discharge of any unwanted material and/or the use of third parties of the Services and/or Contents.
wall:in, therefore, will not be held responsible for damages, losses, damage to goods (including digital data), economic or commercial losses or any kind of damage arising from the Contents and/or Services, or the use contained in them.
Users expressly express wall:in relation to any request made by third parties regarding them with reference to the activities carried out by the same users in the use of the Services and/or in the publication of the Contents.
No content referred to the Services and/or Contents can be considered or constitutes a newspaper; it is not periodic and is updated according to the availability of materials. Therefore, no content referred to the Services and/or Contents can be considered in any way an editorial product pursuant to Law n. 62 of 7.03.2001.

 

Disclaimer and validity of the provisions

The by wall:in order to the failure of the users to respect any provision of these Terms and Conditions can’t in any case be considered a waiver of the same. The invalidity of one or more agreements contained in this Contract will not result in the invalidity of the entire Contract and/or other individual agreements.

 

Applicable law and competent court

Any question related to these Terms and Conditions will be governed by Italian law, any dispute arising from them will be devolved to the exclusive jurisdiction of the Court of Genoa accepted and recognized as conventional forum.
